Delk Siding Solutions – Terms and Conditions
Services Provided
Delk Siding Solutions provides professional siding installation, repair, and maintenance services, as well as exterior remodeling and limited interior access as required for window installation. We strive to deliver high-quality services using skilled professionals and appropriate materials. The scope of work will be determined through consultation with the client and specified in a written agreement or contract.
Client Responsibilities
Clients are required to ensure all areas, both interior and exterior, are cleared of furniture, wall decorations, personal belongings, and fragile or valuable items prior to the commencement of work. Delk Siding Solutions is not responsible for damage to such items left in the work area. Delays caused by uncleared workspaces may result in rescheduling or
additional charges.
Estimates and Pricing
We will provide a detailed estimate for the proposed work, including the cost of materials, labor, and any additional services requested. Estimates are valid for a specified period. Changes to the scope of work may result in an updated estimate. Prices may change due to unforeseen circumstances or material cost increases, which will be communicated in advance.
Payment Terms
A deposit is required before scheduling the work. Half of the balance is due at 2/3 completion, and the remaining balance is due upon completion, unless otherwise agreed in writing. Payments can be made by cash, check, credit card, or other approved methods. Late payments may incur interest or fees as permitted by law.
Cancellation and Rescheduling
Clients must provide advance notice to cancel or reschedule. Any costs incurred due to cancellation or rescheduling may be charged. If cancellation occurs, the deposit is forfeited. We reserve the right to cancel or reschedule due to inclement weather, material delays, or other uncontrollable factors.
Scheduling Services
Exterior work is weather-dependent. Although we aim to meet the agreed schedule, delays may occur due to weather, material delays, or other unforeseen issues. Scheduling is approximate and may change.
Warranties and Guarantees
We provide a limited 5-year warranty on workmanship and materials we supply for siding installations and repairs. Remodeling work (excluding siding) carries a one-year limited warranty. This warranty excludes materials provided by the customer, normal wear and tear, structural issues beneath the siding, and damage from natural disasters, accidents, or misuse. Manufacturer warranties on materials will be passed on subject to the manufacturer’s terms. If existing gutters must be removed and reattached to facilitate siding or other exterior work, and the client has chosen not to replace them, Delk Siding Solutions assumes no responsibility for any damage, leakage, or failure in performance following reinstallation. Older gutters may be brittle, corroded, or structurally compromised, and the removal process may expose or worsen pre-existing issues. Reuse of existing gutters is done at the client’s risk, and no
warranty is provided on reattached gutter systems.
Limitation of Liability
Our liability is limited to the cost of services provided. We are not responsible for damages arising from pre-existing structural issues, natural disasters, or issues beyond our control. This includes damages to areas or items not moved by the client as required.
Subcontracting
While all current work is performed by in-house personnel, Delk Siding Solutions reserves the right to engage qualified subcontractors. We remain responsible for the quality of all work performed under our contract.
Insurance
Delk Siding Solutions maintains appropriate liability insurance coverage, including general liability and, where applicable, workers’ compensation, to protect against personal injury or property damage that may occur during the course of our work. In accordance with Michigan law, we are not responsible for vehicle-related damage or injury I acknowledge that I have read and understand this page. Initials: arising from the use of motor vehicles covered under Michigan’s No-Fault Auto Insurance Act. Clients are encouraged to consult their own homeowners or auto insurance policies to determine the scope of their coverage for incidents occurring on their property. Our insurance does not extend to cover damage to customer vehicles, driveways, or surrounding property unless caused by demonstrable negligence by our team.
Compliance with Laws and Permits
Clients are responsible for obtaining necessary permits. We will assist by providing required documentation or information.
Third-Party Deliveries
Delk Siding Solutions may coordinate with third-party suppliers or delivery services for materials. While we strive to work with reputable providers, we are not responsible for any damage to driveways, landscaping, structures, or personal property caused by third-party delivery vehicles or personnel. Any such damage must be addressed directly with the delivery company. Clients are encouraged to be present during deliveries if they wish to oversee placement or routing. We will cooperate in providing information to assist with any claim the client wishes to make.
Termination
Either party may terminate the agreement in writing due to breach of contract or violation of these terms. Termination may involve financial obligations as defined in the contract or applicable law.
